QUESTON OF PRIVELEGE, DELEGATE CROTTY, in reviewing notes, looking at document, referring to Council Rule 20Efor legislative counsel that bill referred to committee twice that permanently removed. april referred to Naabi and again to Naabi in July. Is this legislation in order according to Council Rules?

INTERIM SPEAKER SETH DAMON, Rule 20E says legislation referred twice to committee, it will be permanently removed from agenda. And it was at council and referred to Naabik’iyati Committee April 18, 2017, and returned to Council and referred to Naabi on July 2017. Kind of grey area and we should have returned to Council and dealt with in July 8, 2017 so as speaker I deem it out of order which is subject to challenge. so Legislation 355-16 is off the agenda.

DELEGATE EDMUND YAZZIE CHALLENGES INTERIM SPEAKER DAMON DECISION.

DELEGATE LEONARD TSOSIE, go Crotty. Interim Speaker Damon ruling correct. And tabled cause not enough votes so now trying to push through. And for all pple looking on web, it would be shameful for us to push through and goes against rules. makes us look lawless. World looking at us. Receiving comments that watching on computer and comments coming in. Challenge telling us, Let’s be lawless. The heck with the rules. Rules says two times referred and bill removed. Asked Shopping center to put into trust and they won’t do. Not about whether project worthy but safeguarding people’s money. And there was request for another feasibility study about whether
Flagstaff taking clientel. We have rules that are very clearn.

DELEGATE OTTO TSO, staff should not have put on agenda if knew bill out of order but to remove legislation from Council requires two-thirds vote of Council.

NOTE – LEGISLATION CAN ALSO BE REMOVED IF RULED OUT OF ORDER

DELEGATE CROTTY, thank you to veterans patiently waiting for Council to get their legislation. Reading from book is that bill would be permanently removed if referred twice to committee. And haven’t heard from challenge what is their issue with challenge. And bill referred to Naabi by Council more than twice. And understand that delegates support legislation 0355-16 but what problem do they have with this Rule.

QUESTION OF PRIVELEGE, DELEGATE STEVEN BEGAY, says Ruling only made by Point of Order, not Question of Privilege.

INTERIM SPEAKER DAMON, after ruling, challenge can be made and debate occurs. Not states why challenge made.

QUESTION OF PRIVILEGE, STEVEN BEGAY, i am pointing out that Crotty raising Question of Privilege to Rule legislation out of order and requires Point of Order to make Council aware of violation of Rules.

DELEGATE JONATHAN HALE, our rule book, way Crotty brought up, the Rule still exists so rather than drag everyone through us through the mud. It is already done and now going forward we know. It’s already done twice. It’s in our laws so we already talked to them and it will take a month to put land into trust. And so I am withdrawing my Legislation 0355-16.

AND DELGATE EDMUND YAZZIE WITHDRAWS HIS CHALLENGE.
