Legal concerns over Gaming Enterprise tables confirmation
February 13, 2014 Professional Journal

Naabik’iyati back in session at 4:39 p.m.

SPEAKER NAIZE
The Committee has question over Gaming Enterprise Board and the replacement of Martha King with Omar Bradley.

NAVAJO DEPARTMENT OF JUSTICE ATTORNEY KARIS BEGAYE
Gaming Enterprise has specific designations which is different from other enterprise Board. I did review Martha King’s confirmation and President Shelly specified that King would serve on Board’s at-large position. If you look at Title 5, it identifies qualifications of Gaming Enterprise Board and so if have anyone with those qualifications then it complies with Board requirements.

to me Board qualifications create conflict cuz individuals could raise concerns about why there were no announcements for vacant position for individual holding juris doctorate or any of the other qualifications for individuals wanting to serve on Board. if individuals are selected based on vacancies that are announced.

DELEGATE KATHERINE BENALLY
This would set bad precedent if Committee approves. President Shelly needs to work on Board vacancies. The Resources & Development Committee has been asking for appointments for Boards. And there needs to be law that mandates that once a Board member’s term ends that that’s it; they can’t serve until replaced. But the way that law is made it allows board members to serve and serve and I think there’s some issues with board members continuing to serve simple because of the “buddy system.”
