concerned about section B-2 to approve all premium and rate obligations. under section A it says “subject to Budget & Finance Committee” for selection of insurance companies. so what is different from policy and rate making and impact to budget regarding authority of Commission. is amendment needed for B&F to have final authority since they deal with budget.

PAGE 2, crime: covers white collar criminal activities. that’s what it is “crime coverage.” Other question is line 20 to 21, award damages and that is still in practice and within risk management authority and for third party files claim against tribe and if liability determined, risk management paid out and goes thru controller and not taken to Risk Management. but if claim exceeds for over $100,000 then it returns to Insurance Commission. Internally, tribe has claims handling process.
Regarding CRIME, that is all coverage under risk management.

regarding Delegate Witherspoon questions, there are 3 insurance programs and each has to be re-done and Commission reviews for best premium. tribal insurance is part of employee benefits.

Question for NDOJ and Legislative Counsel, we are amending Title 2 and why do we have plans of operations in Title 2? so are we dealing with plan of operation. On page 7, heard sponsor say that this under Health, Education, and Human Services Committee but we are amending to include another committee.

if emplyee engaged in loss of $80,000, wud insurance cover? Yes and No. Tribe has gone thru large white collar crimes and when market out, $250,000 deductable, and when Navajo Nation has less than $250,000, “we eat it.” and tribe includes enterprises. right now we have lot of crime losses that are less than $250,000.
