HERE AT NAVAJO CONCIL SPECIAL SESSION WHERE ONLY ITEM IS LEGISLATION 0367-13.

I raised this question when amendment proposed by Delegate Begaye about why he instructed Council to vote with majority vote. Title 2 allows to maneuver and address in regular session, not special session.

DELEGATE LEONARD TSOSISE
This is wrong move by Delegate Damon II. We thot we were moving along but now this type of foolish activity happening to make sure Legislation 0367-13 passes. If Delegate Begaye’s amendment wasn’t in writing, you are responsible Speaker Naize. We debated it and we thot Delegate Begaye made an amendment.

You are now saying that Delegate Begaye’s amendment was put in Legislation 0367-13 but Delegate Damon II amendment is to remove that amendment. But it all started with opinion from Attorney General Harrison Tsosie that the waiver of tribal sovereign immunity didn’t require a 2/3 vote or 16 “yes” votes by the Council because the former Council waived tribal sovereign immunity for the current council. But Speaker Naize during the legislative process repeatedly told the Council that this legislation required 2/3 vote until Dec. 23, 2013, when Attorney General Tsosie issued his memo that a majority of the Council does not support.

The 2/3 vote was inserted in Legislation 0367-13 by the opposition to make Legislation 0367-13 fail. I withdraw my amendment and I will not be held responsible if it fails.
