October 23, 2013 Professional Journal

Navajo COUNCIL DEBATING AMENDMENTS TO NTEC PLAN OF OPERATION

DELEGATE ELMER BEGAY
I wanted more than 10 percent of profits from coal mine to go into renewables which is part of NTEC plan of operation. I wanted 50 percent.

DELEGATE LORENZO BATES
I heard key words and one that stands out is Deal Killer, other is federal remedy, and Dine Power Authority.
Address federal remedy, explained in slimist event there is federal remedy to address anything that has occured in the past. Going forward it becomes our responsiblity. We understood that wen we created NTEC.
And are we saying that we don’t trust NEPA to protect our own interest.
Deal Killer? is this last attmept to kill deal. When I lok at amendment and i remember wat we talked about at Naabi and lot of that in executive session. We asked questions.
I agree with expertise in front of us that if we approve this amendment that we might as well walk away from this deal.
DPA had no track record. It was a pie in the sky project. These companies we are talking about have track record from early 60s and generated revenues back to tribe. Do we not have faith that this track record continue.
Ask Council to vote Red on Delegate Begaye amendment.
And did Navajo Department of Justice generate Begaye’s amendment?

DEPUTY ATTORNEY GENERAL BOBROOF
I didn’t generate Begaye amendment and I didn’t authorize anyone to generate amendment.

DELEGATE RUSSELL BEGAYE
Hear Deal Killer and if absolutely nothing wrong with mine then take out exhibit G. Gundeson said if buy car, seller not responsible. But not fully testing whole mine. And amendment is just business, not about buy as it, and if anything wrong then seller fixes. that is business. Waiver came to us late in the game. First week of October. Didn’t see April, May, June, September. It’s a johnny came lately. to say did due diligence, untrue. and BHP say “oops we forgot.” BHP shud be responsible. wat if worker makes health claims? I’m here to protect land, water, coal, Navajo people.
