Ratification of Navajo Oil & Gas Company charter removed from Naabi agenda

HERE AT NAVAJO COUNCIL NAABIK’IYATI COMMITTEE IN THE COUNCIL CHAMBER IN WINDOW ROCK WHERE NAABI IS IN A HEATED DEBATE ABOUT REMOVING FROM ITS AGENDA LEGISLATION 0220-14, RATIFICATION OF THE NAVAJO OIL & GAS COMPANY CHARTER.

NAABI COMMITTEE MEMBER DELEGATE ALTON SHEPHERD
I would ask Delegate Edmund Yazzie to amend his amendment for removal of LEGISLATION 0220-14, and to include that

i brot this before you that the Council approved & created Navajo Oil & Gas was a Section 17 Corporation, but there was no action taken. so are we going to change in the middle of the game. sadly this is a private corporation and so Navajo Department of Justice has nothing to do with Section 17 Corporation. We did what we did and NDOJ got involved and here we are.

we need to keep on agenda and ratify the NOG charter and move on.

I object to putting Navajo Oil & Gas as Section 17 Company and what is happening here and has been happening has validated my concerns. Right now Navajo Oil & Gas under umbrella of Navajo Nation and so NOG is not paying taxes and leases. So what make NOG private. I said before that if NOG wants to be private/section 17 corporation then NOG needs to return all tribal assets, including Navajo name. I wish BIA take trust responsibility seriously but BIA didn’t. Delegates pressured them but this is where we are at. BIA shud have said that there are a lot of concerns and questions that need to be resolved before BIA made decision. And even if there is BIA policy that the NOG charter is basically ratified if there is no action/decision by Council in 45 days, the Council has right to send letter to BIA to stop any ratification before forensic audit finished and the Naabi Committee & Council both need to wait until that audit if finished before taking any action on the charter of NOG.

you can delete and simpson asked that it not return until forensic audit completed. there is no committee rule that stops this legislation from moving to council, even if 0220-14 is removed by committee. but when it gets to council that is when the council can place hold on 0220-14 until forensic audit complete. this committee does not have the authority to remove 0220-14 from its agenda. right now 10 people spoke and five support removal of 0220 from agenda and five oppose.
