NTEC is asking Navajo Council not to trust Navajo courts

HERE AT NAVAJO COUNCL WORK SESSION ON LEGISLATION 0367-13 REGARDING TRIBAL TAKE OVER OF BHP COAL MINING OPERATIONS VIA NAVAJO TRANSITIONAL ENERGY COMPANY. AS THE COUNCIL DOORS OPERN, YOU CAN HEAR PEOPLE ON A MICROPHONE TALKING. THE COUNCIL CHAMBER IS PACKED WITH BHP COAL MINE WORKERS, GRASSROOTS GROUPS, NAVAJO CITIZENS. IT’S WONDERFUL TO SEE THE PEOPLE INTERESTED IN THEIR GOVERNMENT.

much of the reclamation has already been done. has great deal of work done in assessing environmental impacts where coal ash buries under ten feet of earth. We went out there with Navajo Environmental Protection Agency Etsitty and he was comfortable with coal ash reclamation. And coal ash not Navajo Nation and NTEC liability. If there are some unforeseen impacts from coal ash then NEPA and US EPA will go in and Four Corners Power Plant pay and if they don’t pay then US EPA and NEPA goes after them.

I believe the right place to start is within Navajo court system and when u ask us to waive the law, u r telling us the council not to believe in Navajo court system. I for one resent that. and if the Navajo courts rule against them, they can appeal to outside courts. no one preventing them from using outside courts. Who knows, no one has tested court system where court orders Navajo Nation to pay.
