The Navajo Board of Election Supervisors scheduled today’s special meeting last week to hear from Navajo Nation Attorney General Harrison Tsosie regarding the Navajo Nation Supreme Court’s Oct. 23, 2014, approval of a Writ of Mandamus from presidential candidates Dale Tsosie and Hank Whitethorne that orders the Navajo Election Office, which is headed by Edison Wauneka, to move third place winner of the tribal primary presidential race into second place, which was vacated when the Navajo Nation Office of Hearings and Appeals disqualified presidential candidate Chris Deschene on Oct. 9, 2014.

The special Board meeting today, Oct. 27, 2014, was scheduled to start at 9 a.m. today. The Board decided to postpone their meeting to 1 p.m. after Board Chairperson Wallace Charley announced that Attorney General Tsosie was still writing his legal advice to the Board and that President Ben Shelly was meeting with some “young” attorneys. Charley had also informed the Board this morning that Shelly would be attending their meeting.

Charley had also said at last week’s special board meeting that he expected Shelly to sign the emergency legislation approved by the Council in the early morning hours of Oct. 23, 2014. The Council approved legislation 0289-14 with a vote of 11 in favor and 10 opposed. It was a tie vote and Speaker Pro Temp LoRenzo Bates broke the tie with a “Yes” vote. With the Council’s approval of 0289-14, it has now become CO-47-14 RELATING TO AN EMERGENCY; TO ADDRESS A MATTER WHICH DIRECTLY THREATENS THE SOVEREIGNTY OF THE NAVAJO NATION; AMENDING LANGUAGE REQUIREMENTS OF THE NAVAJO NATION ELECTION CODE. But this morning, Shelly had not signed CO-47-14.

Attorney General Tsosie just arrived to the Board meeting. It is now 1:13 p.m. Charley called Board meeting to order at 1:12 p.m.
