Navajo Council now arguing over whether or not President Shelly’s term ends on Jan. 13, 2015
December 30, 2014 Professional Journal

Navajo Council now on Legislation 0341-14, which would nullify August 2014 Primary Election so a new 2015 Primary Election could be held followed by a 2015 General Election.

DELEGATE DUANE TSINIGINE
this is a very sensitive issue and so why is Delegate Witherspoon asking to have 23rd Council take action on 0341-14. he voted in support of amendment 1. maybe that’s just politics. so i urge my colleagues to support this.

DELEGATE WITHERSPOON
i try to get legislation in best form. and that is why i asked about the impact to tribal staff serving under speaker and president. but i have not received an answer.

DEPUTY ATTORNEY GENERAL BOBROFF
The Navajo Justice Department believes that there will be no vacancy in the presidential office and so there is no reason for Speaker to become interim president, which is based on NDOJ MEMO.

DELEGATE TSINIGINE
yes, its bias. all delegates have right to vote based on civil liberties of people/constituents and what their people/constituents are telling them.

DELEGATE CHARLES DAMON
since no answer to Delegate Witherspoon, the president’s office will be in limbo. so can Vice President Rex Lee Jim be Interim President?

CHIEF LEGISLATIVE COUNSEL LEVON HENRY
can vice president become interim president? the LEGISLATIVE COUNSEL MEMO states that president and vice president terms end at noon on Jan. 13, 2015, and speaker assumes role of president. in talking with staff and if situation of speaker across street being interim president then all appointments temporary up until president and vice president elected and take oath of office.

DEPUTY ATTORNEY GENERAL DANA BOBROFF
our memo, December 2014, we wrote that president stays in office until new president sworn in and vice president stays too.
