Navajo Council loses quorum on vote of $3 m. for college students summer jobs

NAVAJO COUNCIL CALLING ALL DELEGATES…NEED QUORUM. ELEVEN DELEGATES IN COUNCIL CHAMBER AT 5:44 P.M.

12 DELEGATES ON FLOOR AND SPEAKER PRO TEMP BATES MAKES QUORUM OF 13 AT 5:45 P.M.

NAVAJO COUNCIL VOTING ON AMENDMENT 2 TO LEGISLATION 0102-14, WHICH IS FOR THE APPROPRIATION OF $5 MILLION FOR ALL 110 CHAPTERS. AMENDMENT 2 IS FOR RESOLUTIONS OF SUPPORT FROM VARIOUS CHAPTERS TO BE ADDED TO LEGISLATION 0102-14.
12 IN FAVOR, 0 OPPOSED

AMENDMENT 3: DELEGATE LEONARD TSOSIE’S REQUEST FOR ADDITIONAL $3 MILLION FOR 110 CHAPTERS FOR COLLEGE STUDENTS FOR SUMMER EMPLOYMENT.

DELEGATE LORENZO CURLEY
As soon as this $3 million is released to the chapters, the chapters must use it this summer to hire college students and not save it and use it later in the year or until July. I want to see chapters have college students on the job after a week of receiving $3 million. I think that’s reasonable.

DELEGATE LEONARD TSOSIE
i agree but rather than first week, use word, “timely”, or no later than second week of june because by that time, chapters shud have budgeted funds.

DELEGATE JONATHAN NEZ
I think we’re getting sloopy, maybe cuz tired. The other amendment to $5 million, at least at budget form. Delegate Tsosie’s amendment didn’t have budget. And so I’m going to oppose.

There is language in Legislation 0102-14 for chapters to expend funds within fourth quarter.

Title 2 doesn’t call for budget form and it’s archaic.

DELEGATE TSOSIE SAYS COUNCIL SHUD RECOGNIZE ONLY PRESIDENTIAL CANDIDATE STILL IN COUNCIL. TSOSIE REFERRING TO DELEGATE KENNETH MARYBOY, WHO SAYS THAT HE ACCEPTS THE RECOGNITION AS LONG AS ITS FOR HIM AND NOT DELEGATE DWIGHT WITHERSPOON. FRONT PAGE OF NAVAJO TIMES NEWSPAPER HAS PHOTOS OF PRESIDENTIAL POLITICAL CANDIDATES AND KENNETH MARYBOY IS IDENTIFIED AS DWIGHT WITHERSPOON.

OFFICE OF MANAGEMENT AND BUDGET DIRECTOR DOMINIC BEYAL
Tribal Appropriations Act sets guidelines/laws for years for supplemental funding. during annual budget process, whenever adding new initiatives to budget, you are required to provide new budget forums unless moving around money in same account. so refer to attorney whether deviating from that requires waiver of Appropriations Act.

820, overall budget policy and supplemental appropriation states no adherance to Budget Instruction Manuel.

He accuses us of being lawless but he’s being lawless.

CHIEF LEGISLATIVE COUNSEL LEVON HENRY
the language in the law mandates a supplemental appropriation process that is for annual budget process, not during the year and so no waiver of law and no need for 2/3 vote.

CALL FOR VOTE ON DELEGATE TSOSIE’S AMENTMENT FOR AN ADDITIONAL $3 MILLION FOR COLLEGE STUDENTS FOR SUMMER EMPLOYMENT at 6:16 p.m.
10 delegates voting. Speaker Pro Temp Bates repeatedly calls for delegates and when no more delegates vote, Bates announces that there is no quorum at 6:20 p.m.,
