Navajo Council Delegate Tsosie says Pardon for Election Board is about addressing injustice

NAVAJO COUNCIL DEBATING ADDITION OF LEGISLATION 0391-14, PARDON OF NAVAJO ELECTION BOARD, TO ITS AGENDA BY PETITION OF 13 DELEGATES.

DELEGATE LEONARD TSOSIE
As to remedies, the election board;s only remedy is Council. And i don’t mind sitting in jail to uphold justice for election board. and chief justice herb yazzie is not trial court but he holds people in contempt and throws them out of office. if council allows chief justice behavior then he will take over everything.

if you read rule, it does not say you shall not make any challenges when making pardoning and we done it for all gamits of decision so we are not getting ahead of our selves. if you read title 2 section 102, it says all powers not delegated are reserved to council. we don’t claim that we have thought of everything. so precedent set when pardoned Chairman MacDonald. If we can put on agenda and provide for relief and if you don’t want to provide for relief then vote against. what is so hard about stamping out injustice.

he asked if favorable vote today, how impact special elections today. today’s special elections are for council positions not in 2014 General Election. The votes today would be impacted.

DEPUTY ATTORNEY GENERAL BOBROFF
i agree with chief legislative counsel.

DELEGATE DWIGHT WITHERSPOON
this needs president’s signature and opens door for Election Board to file grievance to allow two of them to be candidates for council positions again.
