Greetings Relatives/Frens/Humans, the Navajo Nation Council has convened its two day special session for Dec. 28 & 29, 2022, via teleconference, social media, and in-person at the Navajo Council chambers in Window Rock, Ariz.

1:24 pm, 12.28.22, Navajo Council has started their special two-day session. On the Council’s proposed agenda is K. LEGISLATION 0228-22: An Action Relating to the Resources and Development Committee, Naabik’íyáti’ Committee and the Navajo Nation Council; Approving the Oil and Gas Operating Agreement Between the Navajo Nation and EOG Resources, Inc., for Certain Trust Lands in the Upper Fruitland Chapter and the Nenahnezad Chapter, Navajo Nation (San Juan County, New Mexico) SPONSOR: Honorable Rickie Nez & CO-SPONSOR: Honorable Elmer P. 2:20 pm, 12.28.22, I missed something while I was bringing in wood…But there’s a very public Debate happening between Delegates Carl Slater & Eugenia Charles-Newton regarding what sounds like was an accusation by Charles-Newton against Speaker Otto Tso for being biased. And so now there is a Point of Order Duel between Charles-Newton & Slater, which Speaker Tso ends by Shouting at Both Delegates to Stop Arguing on the Council floor. Speaker Tso also notes that these Disputes take time away of Time allocated for Council two-day special session.
Delegate Slater said add 0239-22 to Consent Agenda of Legislation regarding all Expenditure Plans for ARPS funds for Delegates, which do not have proposed Amendments pending. Delegate Daniel Tso Seconds Slater’s Amendment 2.

5:19 pm, 12.28.22, Delegate Amber Crotty motions for Amendment 1. She says her amendment is to Create opportunity in communities, such as service industry. Thinking about the many decades that minerals in communities and amount of revenues reported by the Navajo Minerals Dept
Delegate Rickie Nez says your amendment is for 25% of revenues received for communities or 25% tax on Navajo Oil & Gas/corporations. Under Title 26, section 103: chapter authority, #8 local tax code recommended by Navajo Tax Office & acted on by Council. I ask for Navajo Tax Commission to explain if this proposed Community Opportunity Benefit.
Speaker Otto Tso calls for Navajo Tax Office & Navajo Div of Economic Development to answer questions.
Delegate Amber Crotty, in response to Rickie Nez, says this is not tax. This says that 25% of money received from Operating Agreement will go into Community Opportunity Benefit. This is not creating a tax. If you have chapters impacted by exploitation of natural resources, they will share in the royalties. No language in navajo energy policy for local control, remediation, environmental protection.

5:57 pm, 12.28.22, Navajo dept of justice Roderick Begay says that it appears that the proposed Community Benefit Development Fund is mimicking Navajo Gaming Enterprise Fund for chapters, which is already being done. And this is not a Tax. It’s only giving a certain percentage of revenues to chapters impacted by the exploitation of natural resources.

6 pm, 12.27.22, Some of the Council delegates, mostly males, are getting Upset that Delegate Amber Crotty Basically Outsmarted them with her Amendment 1, which proposes to allocate 25% of revenues from helium development by Navajo Oil & Gas for Sanostee Chapter.
Delegate Rickie Nez claimed that Delegate Crotty was involving herself in Navajo Tax Office business because her proposed 25% Community Opportunity Development was from NOG and helium royatlies and only for for Sanostee
Delegate Herman Daniels says the helium revenues need to be shared among 110 chapters.
NOTE – Now these Male Delegates and Delegate Charles Newton are finally
Delegate Crotty says there is no agreement or percentage between NOG
& Sanostee Chapter because NOG CEO McClure doesn’t want to sign Community Benefit Development Fund until Council approves operating agreement between NOG & Navajo govt for helium development.
Legislative Branch receives more funds than chapters. And funding for chapters has been stagnant and always some sort of shortfall. I have not seen evidence, of the collective distribution of navajo general funds, which are unrestricted. They are navajo funds.
Now, like gaming, we can change 100 years of history, with window rock central thinking, has claimed all those royalties and not considered those communities impacted.
I’m not sure if chapters aware of how much central govt receives in royalties. Maybe $250M annual projected revenue and sanostee get $250,000. That is unfair. I hear colleagues saying need more direct services.
In having this conversation, I realize how much overhead in Window Rock. And Council approves annual operating budget of navajo govt.
What is stopping any Delegate from reading operating agreement to see what offered and if opportunity there to enhance benefits. If we can’t have comprehensive energy policy there is no way to get this type of funding for a chapter. That is why have legislation that creates division cuz we are all trying to get a share.
Delegate Paul Begay wasn’t part of discussions regarding APS lease because he was not part of Council and delegate at that time didn’t read Operating Agreement to find out how get more benefits for chapters.
How is it that Navajo depts can make decision that impact chapters/communities even though the people oppose.
WE need to follow the Navajo dollar. I’ve never made a million dollars. This is our people dollars and we have the power/ability to pull those dollars back to chapters and district to empower them to develop communities.
We need to help our communities/chapters understand how the annual Navajo works and we need to comply with the budget.
My amendment is to change 100 years of how central govt has benefited from these resources and there has not been a fair distribution of these resources.

6:25 pm, 12.28.22, Delegate Kee Allen Begay CanNot Think Outside the Box!!!! He has no clue that Delegate Crotty’s amendment 1 is not funding one chapter; it is about funding local govt & communities and Not Window Rock/Central Govt with revenues generated from the exploitation of natural resources in chapters/communities.
How much revenue is being generated?
Mineral Dept director Cheromiah didn’t negotiate Tacitas lease because that was when BIA. Called Standard Operating Agreement. Lease agreements can be bought by other companies which is how Navajo Transitional Energy Corporation acquired Tacitas.
Mineral dept supports Delegate Crotty’s amendment 1 for certain percentage, but for all royalties to go to 109 chapters is not feasible and not why agreements negotiated – Bring in revenues to Navajo govt..
Navajo uses revenues for services, such as Transit system and employee payroll. Road repairs are so expensive. Royalties help with infrastructure, central govt, and local govt.

7 pm, 12.28.22, Delegate Eugenia Charles-Newton says she’s ‘confused”. She doesn’t understand Delegate Crotty’s Amendment 1. Is this about whether to giver royalties to chapters or central govt where services are provided to all the people.
Delegate Crotty said only a few individuals decide how to divide up annual revenues for revenues. That’s the three Navajo govt branch chiefs. The question is whether this is the best way to distribute funds to our people. Thisi s policy issue. If you have discussions that constituents supports giving royalties to Window Rock, then you don’t support my amendment.
What does it mean to live in an impacted community by the exploitation of natural resources?
In research to support or help restore some of impacted communities, there have been no legislation to help those communities. But if what is happening with distribution now is working for
10 percent to direct services. We had $25M in personnel lapse fund, which is from vacancies. How did we use those dollars? For northern agency, I tried to provide to Shiprock jail, etc. But Budget & Finance Committee decided not to support and then Council approved.
Why does it take 30 years to build a road?
My amendment 1 is simply about sending royalties to chapters/communities. But if your constituents support sending royalties to Window Rock because window rock knows how best to spend revenues for community.
Minerals Dept holds years of historic knowledge. Former Minerals dept was notorious for getting best deal. When talked about helium, he said get expert in room to understand potential of helium. And that is what Nation lacks. We tried to get consultants and that funding disappeared somewhere. We depend a lot on companies to give us this information. In allocating dollars, we need to ensure we get the best information with revenues supporting Navajo govt.
There has been a lot of loss opportunities. In 2020, lost more than $200M in matter of days because of COVID outbreak. 2008 huge decline. I don’t think Parks & Rec Dept shud collect money without community inpat and understanding how communities are impacted and resources that community receives.

7:48 pm, 12.28.22, Delegate Mark Freeland says he thinks about what Delegate Rickie Nez said yesterday about generating revenues for services for Navajo govt. This helium development is an opportunity for the entire Navajo Nation.
We try to work with chapters on audit and so how work with making sure that revenues from helium development for one chapter are not misused and audited.
Maybe we can work on distribution percentage instead of 25%.
Speaker Teecnospos well which is 7 to 8 generate $15M-$18M. And two wells at Sanostee generate $100M over 7 to 8 years. Speaker calls on NOG CEO McClure to provide more information and so McClure starts talking numbers and that they are basing their model on Assumptions….NOTE – LOL LOL LOL LOL
NOTE – Please keep an Eye on the Councll’s Vote on Delegate Crotty’s Amendment 1 because it is a Clear Sign of What Delegates Support Local Govt and what Delegates support the Status Quo!!!

7:57o pm, 12.28.22, Delegate Mark Freeland asks how to prevent the misuse of the proposed 25% of revenues from helium development by Sanostee chapter because there is a history of high incidence of misuse of funds by chapters.
Navajo dept justice April Quinn says she not the one to speak on that issue.
NOTE – Why is Delegate Mark Freeland concerned about Misuse of funds when he traveled Several Times to the Navajo govt’s ranches in Colorado on the Navajo people’s money. I asked the Navajo Office of Legislative Services for the Cost of the Travel of the Resources & Development to the Navajo govt’s ranches in Colorado. I never received a Report. And so since Delegate Freeland is so concerned about Accountability of revenues, I’m sure he’ll be more than willing to do an INTERVIEW with me about his Trips to Colorado and Twin Arrows and how was Produced/Benefited from his Travels.

8:10 pm, 12.28.22, Delegate Amber Crotty informs Council, I think all our impacted communities have been treated unfairly when it comes to financial assistance. There is formula for chapters; it’s the 50-50 formula. Is that enough? Never. Has there been increase? Moderate when added salaries of officials. Slight increase when included chapter officials in COLA.
Will there be a high probability of misuse of funds question is an interesting way to address Amendment 1. I am recalling all the audits. We have no power here because I cannot access documents. I have not seen an audit finding of how Navajo Nation Gaming Distribution Fund used.
The Fund Management Plan will be developed after my Amendment 1 approved because the Management Plan determines how Revenues spent.
I support continued discussions on how to Fund Chapters, whether to fund programs that are not providing services, how to create set aside to ensure funding of services that community support. Basic services that everyone of our people have to a right to are electricity, running water, broadband.
We can also look at how to empower local govt, bring in education about annual budget so chapters can develop their own budget; COVID has limited chapter development but it can occur.

8:23 pm, 12.28.22, Delegate Mark Freeland said his question about the buildout and financial process was not answer by Delegate Crotty.
Delegate Amber Crotty says she answer Delegate Freeland question. The financial system under Navajo Div of Community Development and Fund Management Plan would have buildout.

8:38 pm, 12.28.22, Resources and development committee chairman Rickie nez says that if the council allows we, the Dine’, to speak directly to our council then we will take up too much of their time and they won’t be able to get through with all their legislation.
Rickie also says that if the council does allow the three Dine’ to speak then the Council will have to let any Dine’ who wants to speak on legislation before the council to speak. And so he opposes allowing three Dine’ to speak to Council.
Speaker Otto Tso says that he made it clear that there had to be consensus from Council to hear from the three Dine’.

8:44 pm, 12.28.22, Delegate Daniel Tso, who motioned for a new Amendment 1, says he proposed Amendment 1 because of the shared experience of his chapters constituents having health problems from the exploitation of natural resources by the oil and gas industry in their communities. This fund would study health impact of helium exploration and all activities to reduce all negative impacts and this fund would be funded by corporations.
Navajo division of health and Navajo EPA will develop expenditure plan of Fund that will be funded by oil and gas operations. Children and elders are suffering the health impacts of oil and gas operations in eastern navajo.

9:14 pm, 12.28.22, YES Delegate Amber Crotty!!!! Delegate Crotty ask Navajo Oil & Gas CEO McClure for a Listing of Navajo & Oil Gas shareholders, how many meetings were held, and what travel benefits were provided to shareholders by Navajo Oil & Gas.
Navajo Oil & Gas CEO McClue informed Council that on the Advice of legal counsel, we are not allowed to divulge that information without the approval of the shareholder.
NOG CEO McClure says he can say that each shareholder receives $660 per meeting. Typical the shareholders meet once per quarter and have four to six meetings per year. Shareholders are representatives from Navajo Council’s five committees.
Delegate Crotty asks for Navajo justice dept to work with NOG attorney on getting her the information she requested.
Delegate Daniel Tso says we passed legislation on who is appointed to what Navajo govt enterprise and so that info is public information.
Speaker Otto Tso says all the Navajo govt enterprises have shareholders who are Council Delegates.
The Council starts voting on Recessing but then Roll Call vote suddenly stops as Delegate Amber Crotty is asked for her vote.
