Greetings Relatives/Frens/Humans,Since November 2021, the Council has been trying to get Detailed Budgets of where Nez&Lizer want to spend the remaining balance of ARPA, which is about $1.1B. And after getting Detailed Budgets of the location of where ARPA funds would be spent and on what projects and the amount of ARPA funds, That’s when Delegates Found Out that those Delegates that supported Nez&Lizer $1.1B ARPA spending plan had their projects funded.. Delegate Crotty said she spent a lot of time Correcting Misinformation about her amendment to Equally Divide the $1.1B among the 24 Legislative Districts, which consist of chapters. Her Amendment to the Nez&lizer Legislation 0257-21 would allocate more than $44M to each of the 24 Legislative Districts.And the misinformation comes from some Delegates who Promote what they want by Withholding All Navajo Govt Information/Documents/Legislation/Budgets and Only Giving their Side of Council Activities. All Elected Officials should be Presenting ALL Sides of Crotty’s amendment, the pros and cons.Delegates Only Present What They Decide their Communities Should Know. And this wouldn’t Happen if KTNN would practice Journalism Standards and produce News Stories in Dine’ and English and Listen to Navajo Govt Meetings and do News Coverage of them. KTNN should have had a News Reporter with Journalism Knowledge to produce News Stories about has been Happening with ARPA and CARES, insted of reading Navajo Government One Sided Promotional Information!!And WHERE is the Navajo Nation govt FINANCIAL REPORT on where Nez, Lizer, Council, Legislative Branch spent $714 MILLION IN CARES EMERGENCY RELIEF AIDMay Peace Prevail on Mother Earth!

Greetings Relatives/Frens/Humans, the Navajo Council Naabik’iyati Committee continues its Debate, which gets very Heated, on Legislation 0257-21, the $1.1 Billion ARPA spending plan by President Nez & Vice President Lizer.

And Navajo Council Budget & Finance Committee member Amber Kanazbah Crotty continues to Push for her Amendment to Legislation 0257-21, which has the following language:

  1. On page 1, line 12, delete $1,166,003,000 and insert $1,070,298,867
  2. Delete Amendment No. 1 in its entirety
  3. On page 1, line 14, after “FUND””, insert REGIONAL CHAPTER PROJECTS
  4. On page 1, line 14, after “PLANS”, delete FOR WATER AND WASTEWATER PROJECTS, BROADBAND PROJECTS, HOME ELECTRICITY CONNECTION PROJECTS, HOUSING AND HOUSING RENOVATION PROJECTS, BATHROOM ADDITION PROJECTS, AND HARDSHIP ASSISTANCE
  5. On page 5, line 24, amend new paragraph P and add new paragraph Q as follows:
    P. The Navajo Nation Council and Office of the President and Vice-President concurred that, based on their respective public consultation efforts, it is in the best interest of the Navajo people and Navajo communities to first enact comprehensive a Navajo Nation Fiscal Recovery Fund Hardship Assistance Expenditure Plans. To that end, the Navajo Nation Council adopted Resolution No. CD-62-21 providing $557,000,000 in Hardship Assistance for Navajo members to mitigate the financial devastation caused by the COVID-19 pandemic. The President agreed with the Council and signed CD-62-21 into law on January 4, 2022. for Water and Wastewater projects, Broadband projects, Home Electricity Connections projects, Housing and Housing Renovations projects, Bathroom Addition projects, and Hardship Assistance in total amount of one billion one hundred sixty-six million three thousand dollars ($1,166,003,000), as set forth in Exhibits C through H which are incorporated herein.
    Q. The Navajo Nation Council and Office of the President and Vice-President also concur that, based on their respective public consultation efforts, it is in the best interest of the Navajo people and Navajo communities to fund local and regional projects and enact a comprehensive Navajo Nation Fiscal Recovery Fund Expenditure Plan for Regional Chapter Projects in the total amount of one billion seventy million two hundred ninety-eight thousand eight hundred sixty-seven dollars ($1,070,298,867) divided equally between the twenty-four (24) Delegate Regions in the amount of forty-four million five hundred ninety-five thousand seven hundred eighty-six dollars ($44,595,786) per Delegate Region as set forth in Exhibit C.
  6. Delete page 6, line 3, through page 13, line 4.
  7. Delete Exhibits C through H
  8. Insert new Exhibit C
  9. On page 13, line 5, insert new section as follows:
    SECTION THREE. APPROVAL OF THE REGIONAL CHAPTER PROJECTS EXPENDITURE PLAN
    A. The Navajo Nation hereby approves and adopts the Navajo Nation Fiscal Recovery Fund Regional Chapter Projects Expenditure Plan as set forth herein and in Exhibit C.
    B. The Navajo Nation hereby approves total funding for the NNFRF Regional Chapter Projects Expenditure Plan from the Navajo Nation Fiscal Recovery Fund in the total amount of one billion seventy million two hundred ninety-eight thousand eight hundred sixty-seven dollars ($1,070,298,867) divided equally between the twenty-four (24) Delegate Regions in the amount of forty-four million five hundred ninety-five thousand seven hundred eighty-six dollars ($44,595,786) per Delegate Region as set forth in Exhibit XX.
    C. For purposes of NNFRF Expenditure Plans, “Delegate Region” shall mean all the Navajo Nation chapters, both LGA Certified and non-LGA chapters, and Townships, represented by a Navajo Nation Council delegate.
    D. Each Navajo Nation Council delegate shall select Fiscal Recovery Fund eligible projects in their Delegate Region to be funded through a NNFRF Regional Chapter Projects Expenditure Plan. The projects selected by each Delegate shall not exceed $44,595,786 in total.
    E. Delegates may select projects for their Regional Chapter Projects Expenditure Plan from the list of projects, attached as Exhibit xx, that have already been submitted to NNDOJ for an initial eligibility determination and are not included in another NNFRF Expenditure Plan. Delegates may also select projects that have not previously been submitted to NNDOJ for an initial eligibility determination, as long as such projects have received an initial eligibility determination prior to being included on the respective Regional Chapter Projects Expenditure Plan.
    F. The projects selected by each Navajo Nation Council delegate shall be compiled into a Delegate Region Projects Expenditure Plan for their respective Delegate Region and approved by Navajo Nation Council resolution and signed into law by the President of the Navajo Nation.
    G. Delegate Region Projects Expenditure Plans shall be subject to the following requirements and restrictions:
  10. Delegate Region Projects shall fall under one of the authorized U.S. Treasury Expenditure Eligibility Categories set forth in Exhibit H-2;
  11. The funding for any and all projects included in a Regional Chapter Projects Expenditure Plan shall be obligated by December 31, 2024, and fully expended, with the project completed, by December 31, 2026;
  12. Any project, without exception, included in a Delegate Region Projects Expenditure Plan shall be capable of being fully completed by December 31, 2026;
  13. Each Delegate Region Project shall be subject to CJY-41-21’s NNDOJ initial eligibility determination;
  14. Each Delegate Region shall be limited to a total of nine million one hundred fifty thousand dollars ($9,150,000) of Revenue Replacement Projects (Expenditure Eligibility Category 6.1: Provision of Government Services);
  15. Delegate Region Projects shall not include Sanitation Deficiency Service (“SDS”) included on the Indian Health Service 2022 SDS List attached as Exhibit H-3;
  16. All Delegate Region non-construction projects, including planning and design, shall be “project ready” meaning that xxxx; and
  17. All Delegate Region construction projects shall be “construction ready” meaning that xxxx.
    H. The FRF Office shall assist each Council Delegate in developing their respective Delegate Region Projects Expenditure Plans and shall, notwithstanding BFS-31-21, submit each respective Expenditure Plan to NNDOJ for an initial eligibility determination as required under CJY-41-21.
    I. The requirement in CJY-41-21, Section Three (F), to establish a contingency reserve for NNFRF Regional Chapter Projects construction projects shall be implemented on a case-by-case basis through resolution(s) approved by the Navajo Nation Council and enacted pursuant to 2 N.N.C. § 164 (A)(17) and 2 N.N.C. §§ 1005 (C) (10), (11), and (12).
    J. To ensure Delegate Region Projects are completed within the federal Fiscal Recovery Fund deadlines, approved Delegate Region Projects Expenditure Plans shall only be amended by three-fourths (3/4) vote of the full membership of the Navajo Nation Council and signed into law by the President of the Navajo Nation.
  18. Insert new Exhibits -x through x
  19. Page 13, line 25, before “Navajo Nation”, insert After approval pursuant to 2 N.N.C. § 164 (A)(17) and 2 N.N.C. §§ 1005 (C) (10), (11), and (12),
  20. Page 15, line 3, after “Plan”, insert, as long as such projects or services share the same Expenditure Eligibility Category
  21. Page 19, line 5, delete TO HARDSHIP ASSISTANCE EXPENDITURE PLAN
  22. Page 19, delete lines 11 through 18 and lines 24 through 26
  23. Page 19, line 21, after “to”, delete the NNFRF Hardship Assistance and insert another NNFRF
  24. Renumber or re-letter succeeding paragraphs, sections, and exhibits, as necessary and appropriate. The Council and Committee hereby authorize Office of Legislative Services and Office of Legislative Counsel to correct grammatical and other technical errors, including adjustment of comprehensive dollar amounts, consistent with the intent of this amendment. This Amendment supersedes all inconsistent language in any other Committee or Council amendment.

It is now 12:10 pm, 3.25.22, & Naabik’iyati debating Legislation 0257-21, nez&lizer $1.1 Billion ARPA Spending Plan & Amendment by Delegate Crotty to equally divide $1.1B among 24 legislative districts for chapters, which would be $44M for each 24 district.NAVAJO COUNCIL DELEGATE VINCE JAMESSteamboat Chapter has been Waiting for payment for three months from OOC dept. Repo truck arrived at Steamboat for flat-fed truck. The bilaagaan guy told Steamboat Chapter, you guys haven’t paid me and I have the right to take it. According to chapter budgets, there’s a million in budget, but chapter can’t touch it. And the Navajo Govt OOC continues using Purchase Orders so chapters have to wait for Purchase Order Numbers.Please review Chapter SDS Listing, which is not in the Exhibits of Legislation 0257-21. But some Delegates keep calling for a Vote on 0257-21, says Delegate Vince James.

12:40 pm, 3.25.22DELEGATE AMBER KANAZBAH CROTTYThis amendment is Breaking Away from Window Rock StrongHold. When U say red tape, it’s Window Rock. When you ask why your projects were not funded, it’s Window Rock.The amendment also directs nez&lizer to provide technical assistance. $180 million to nez&lizer to get the ARPA funds to chatpers. But list included defunded projects. I’ll say it again, this Council cannot rely on Window Rock to complete your projects.My job here is not to convince you but what have you heard from the community people, which is what is consultation and leadership style, which is where this Amendment came from. If we had talked with nez&lizer ARPA team in summer, we wud not need this amendment because our communities would have been heard.I do not delegate my authority to allocate funding to anyone and my vote is here at council. I will never delegate enterprise to make decisions for my communities. That is what is in the nez&lizer spending plan/Legislation 0257-21.In July. The Council appropriated more than $2 million in COVID assistance. And in December, the Council allocated half a million dollars in Hardship Assistance.What my amendment is saying is that We want involvement in new projects and want vetted projects to move forward.

I worked with Navajo Division of Community Development director pearl yellowman on my projects. But I support Crotty’s amendment.
I’m concerned about Navajo govt housing assistance. I have elder living in home that’s about to collapse. The money does not belong in Window Rock. But like Delegate Paul Begay said we have to do spending right. I agree that DCD does not know what is happening at community level.
We have to fund raise for homes. We have community members traveling miles to buy oxygen.
My grandmother celebrated 104 years. She is blind and needs oxygen. She took care of us when we were young and we are taking care of her. There are elders that have critical needs.
I waited for nez&lizer to step up with increased funding at the local level instead of keeping funds in Window Rock.

It is now 1:14 pm, 3.25.22NAVAJO COUNCIL DELEGAE PERNELL HALONAWe need to vote on Legislation 0257-21. The amendments coming before us should have been proposed earlier. The next Council could be here debating how to spend the ARPA funds. We gave nex&lizer the authority to spend the ARPA funds. The chapters have not said that they do not support the nez&lizer spending plan/Legislation 0257-21 and so they support Legislation 0257-21. I support Legislation 0257-21 without any Amendments.We’re taking funds from other chapters with Crotty’s amendment. And the federal government should fund the former Bennett Freeze, not the Navajo government.

Hear Navajo Nation only hires who they know; it’s not about whether you are qualified, but who you know. Why is NTUA/Navajo Tribal Utility Authority giving Navajo small businesses a hard time to get ARPA funds. But we are looking at 4-5 months of construction.
Are we going to have additional staff to help us spend $44 million?
(Why oh Why hasn’t Delegate Stewart been working with his Chapters to Help them Spend Navajo govt & federal funds so that when his Chapters receive funds that they spend them and spend them according to federal and tribal guidelines.
This effort by Delegate Crotty shows that nez&lizer & Delegates have not been Helping their Chapters spend funds. SMH! WTH!
And so whose fault is it that the administrative and management skills of chapters is so inefficient. I mean, the lack of administrative/management skills of chapters is Nothing New. It’s been Going on For Years.
And nez&lizer received millions in ARPA to administer/manage the Navajo Nation’s $2.1 Billion ARPA funds. And most of the administrative/management funds for the infrastructure projects in the nez&lizer $1.1 billion spending plan/Legislation 0257-21 remain in Window Rock and that is on top of what nez&lizer received to manage the $2.1 Billion in ARPA funds.
And as usual, Stewart doesn’t read or listen, otherwise he would know that Crotty’s amendment provides for technical assistance for chapters. And Stewart should know how to spend Navajo govt funds by now…LOL LOL LOL LOL)
